Gym Membership Agreement

This contract is concluded between the user Juan Manuel Martinez Campos and the gym "Body fitness Atlacolpan S.A de C.V", in which the user (s) of the gym undertake to pay the services as well as being able to use these facilities in a period of one year, which will be counted from the date marked in this contract.

The contractual association of these two parties may be dissolved by the company Body fitness Atlacolpan S.A de C.V, unilaterally when in full violation to the ethics and care statute, the user incurs in violations of the red line order specified in said regulation and in the event that this contract is terminated by part of the user, must make their request for cancellation at least one week in advance, so as not to be credited with a compensation of 50% of the cost equivalent to one month.

For the conclusion of this contract, the parties will be adjusted to the following.

CLAUSES:

First.- Body fitness Atlacolpan, will make the facilities available to users, fully adapting to the type of membership chosen and the internal regulations of this sports institution.

In corresponding compensation, the user will pay Body fitness Atlacolpan, an economic compensation that will be $ 520.00 pesos M / N monthly, corresponding to the type of membership selected and that may be paid in advance or monthly on the date indicated in this contract; the user will have the possibility of direct debit payment into a bank account, as long as it is accepted by the banking institution.

Second.- The right is non-transferable (in the case of being personal) and will correspond to the designated members of the family (in the family plan), without being able to be sold or transferred to third parties.

Third.- The user will allow and assign the use of their data for the formation of a file, which will be kept secret in accordance with the law on public data and will allow you to be formed and delivered a credential with a chip that will carry the corresponding data and credits, covering payments and bonuses to be creditor.

Room.- The user fully accepts by reading and signing this contract that Body fitness Atlacolpan, will not reimburse registration fees already paid in the monthly plan, and in the annual payment, only the remaining months will be reimbursed less the cost corresponding to half a month as compensation.

Fifth.- Users will use their credentials to access the facilities and agree that a record is kept by computer of its entrances and exits as well as the one that the users undertake to conduct themselves in accordance with the corresponding user regulations.

Sixth.- In case of loss of the credential, it will be invalidated and a new one will be issued, generating a corresponding extra cost of $ 100.00 pesos.

Seventh.- Body fitness Atlacolpan S.A de C.V will notify the user of any change in the contract with five days of anticipation and only in this case the resignation by the user will not generate any cost in case of this want it.

Octavio.- In case of accidental destruction of sporting goods or facilities, the cost will be absorbed by Body fitness Atlacolpan S.A de C.V, after examination and expert opinion and in In case of willful destruction and after verification, Body fitness Atlacolpan S.A de C.V will not be responsible for the expenses and may, if necessary, consign to the authority correspondent.

Ninth.- With this contract, the user is authorized to Body fitness Atlacolpan S.A de C.V, to organize tournaments and events at the facilities as well as the one that preventive or corrective repairs and partial closures are carried out without remunerating or reducing the cost of membership.

Tenth.- The goods, losses or damages that occur in relation to the users will remain outside the responsibility of Body fitness Atlacolpan S.A de C.V, each user being responsible for their locker and its security by having space for two personal locks and the regulatory plate of the company.

Eleventh.- The gym parking is exclusive for users and for no reason can it be transferred to third parties, and Body fitness Atlacolpan S.A de C.V, does not lend its parking spaces to any member outside of this. The tips to the managers and caregivers will be the responsibility of the user, knowing that with the purchase of the parking right, the salary of the six caregivers is paid monthly. Caregivers have their corresponding badge and chip credential, which gives them access to all drawers of parking lot, so Body fitness Atlacolpan S.A de C.V requires its users to keep their vehicles tightly closed to avoid drawbacks. The parking video recording service has a cost of $ 50.00 pesos per month.

Twelfth.- If at the expiration of the membership the user does not renew it within two months, in case of opening it he will have to carry out a new procedure losing his rights accumulated, compensations and the parking space, so a new space must be selected or assigned and it will be adapted to the new parameters of the memberships.

Thirteenth.- As a result of this contract, the user authorizes Body fitness Atlacolpan S.A de C.V, to send him communications by his cell phone, Facebook, twitter, email or postal mail of events, promotions, modifications or circumstances related to the gym or its membership.

Fourteenth. The parties that enter into this contract agree to waive their right to submit to the courts of the states of the country, submitting exclusively to those of the Federal District.

Fifteenth.- The recession of this contract will be caused by breach of any of the established clauses or by serious failures of the regulation.

This contract is entered into in Mexico Federal District on May 26, 2014, at the facilities located on Calle Caballo Ballo No. 365-367 of the Ciudad Deportiva neighborhood Cuajimalpa Delegation.
